Introduction

Welcome to Turftics. These Terms of Service ("Terms") form a legally binding agreement between you and Turftics Limited, a company operating under the laws of the Republic of Kenya ("Turftics," "we," "us," or "our").

By downloading, accessing, or using the Turftics mobile application or website (collectively, the "Platform"), you confirm that you have read, understood, and agreed to be bound by these Terms. Please also review our Privacy Policy. If you do not agree, you must discontinue use of the Platform immediately.

1. What Turftics Does (and What It Does Not Do)

Turftics operates as a digital marketplace and Merchant of Record that allows players to discover, book, and manage reservations at independently owned sports turfs and facilities ("Hosts"). Turftics does not own, operate, manage, supervise, or control any venue listed on the Platform. All venue services are provided exclusively by Hosts. Your legal agreement for use of a turf exists solely between you and the Host. Turftics facilitates bookings, processes payments, and provides technology infrastructure.

2. Eligibility and Accounts

You must be at least 13 years old to use Turftics. If you are under 18, you may only use the Platform with the consent and supervision of a parent or legal guardian. Hosts must be at least 18 years old and have the legal authority to list and manage a venue. You are responsible for keeping your login credentials secure and for all activity on your account.

3. Pricing, Payments, and Bookings

Turftics uses dynamic pricing. The price shown at checkout is final and may include service fees. All service fees are non-refundable except where required by law. Turftics acts as Merchant of Record; payments are processed through integrated gateways (M-Pesa, Visa, MasterCard, etc.). Turftics does not store full card or bank details. A booking is only confirmed once you receive a digital confirmation inside the Platform.

4. Cancellations and Refunds

Cancellations are subject to Host policies and Turftics platform rules. Key points:

  • A 2% service fee applies to all bookings and is non-refundable in all cases
  • Less than 7 days before booking → No refund
  • 7 days or more before booking → Full amount paid minus 2% service fee
  • Host cancels at any time → Full refund of all amounts paid
  • Approved refunds processed to the original payment method within 5–14 business days
  • No refunds for no-shows, weather, or change of mind outside the permitted window

In any conflict between a Host's policy and Turftics' platform policy, Turftics' platform policy shall prevail.

5. User and Host Conduct

You agree to use the Platform lawfully. Prohibited actions include bypassing Turftics to avoid fees, harassment, unlawful use, and misuse of other users' data. Hosts must provide accurate listings and safe venues. Turftics is not responsible for venue condition, safety, or Host-provided content inaccuracies.

6. Community Guidelines

We expect respectful behavior, fair play, punctuality, and compliance with applicable laws. Violations may result in warnings, suspension, or permanent ban. Report serious incidents through the Platform or to local authorities where appropriate.

7. Assumption of Risk

Sports activities carry inherent risks. By using Turftics, you voluntarily assume these risks. Turftics does not provide insurance.

8. Platform Disclaimer

The Platform is provided "as is" and "as available." Turftics makes no guarantees regarding venue safety, quality, availability, or suitability.

9. Limitation of Liability

To the fullest extent permitted by law, Turftics is not liable for indirect, consequential, or punitive damages, or for injuries or losses at venues. Total liability shall not exceed the amount you paid to Turftics in the six (6) months preceding the claim.

10. Host Listings

Hosts must provide accurate information and may not circumvent the Platform for direct payments. Turftics may remove listings that violate these Terms.

11. Intellectual Property

All Platform content is owned by Turftics Limited or its licensors. The Turftics name and logo are trademarks. For permission requests contact legal@turftics.com.

12. App Store Terms

Your agreement is with Turftics. Apple and Google are not responsible for the Platform, support, or disputes.

13. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi.

14–20. Additional Terms

We may update these Terms; continued use constitutes acceptance. Force majeure, severability, third-party links, user-generated content, termination, and language provisions apply as described in the full in-app Terms. The English version prevails over any translation.
